1. Scope

This policy describes how personal information is handled when you visit our Shopify store, place an order, contact us, or receive our communications. Applicable privacy rights depend on your location and the legal requirements applying to the processing.

2. Information collected and sources

Information you provide includes your name, email address, billing and delivery addresses, telephone number when supplied, order details, account information if you create an account, communications, and photographs or other evidence submitted with a refund request.

Checkout and payment services process payment information. We receive the payment status and transaction information needed to manage the order; payment providers handle the payment credentials according to their own services and privacy notices.

Website interactions may generate IP addresses, browser and device information, cookie identifiers, referring pages, pages viewed, product interactions, approximate location inferred from an IP address, and checkout events.

Marketing services may process subscription choices, message interactions, website activity, and advertising identifiers. If lawfully enabled, customer-matching features may use transformed or hashed contact identifiers.

Sources include you, your browser or device, Shopify, payment services, fulfillment providers, carriers, and the analytics or advertising services listed below.

3. Purposes of processing

We use personal information to process payments and orders, arrange shipment, provide order updates, administer refunds, respond to inquiries, maintain accounts, prevent fraud and abuse, secure the store, comply with accounting and other legal duties, and establish or defend legal claims.

Where permitted and subject to the required choices or consent, we also use information to measure website activity, assess advertising performance, develop advertising audiences, and send marketing communications.

Information reasonably necessary to fulfill an order must be supplied for us to perform that service. Optional marketing consent is not a condition of buying.

4. European and United Kingdom legal bases

Where the EU GDPR or UK GDPR applies, order fulfillment and requested pre-contract steps rely on contractual necessity. Mandatory records and lawful disclosures rely on legal obligations.

Security, fraud prevention, and necessary business administration may rely on legitimate interests where those interests do not override your rights. Optional marketing and tracking rely on consent where required.

Consent can be withdrawn for future processing without affecting the lawfulness of processing already performed. We do not treat acceptance of our terms as consent to optional tracking.

5. Recipients and disclosures

Personal information may be disclosed to Shopify for store hosting and checkout; payment providers for transaction processing; our third-party supplier in China for fulfillment; carriers and delivery partners for shipment; service providers assisting with communications, support, security, accounting, and legal administration; and the analytics and marketing providers listed in Section 6.

The supplier and carriers receive the information reasonably necessary to fulfill and deliver the order. Refund photographs and support correspondence are used to assess and administer the request, not as advertising material.

Information may also be disclosed when legally required, to protect lawful rights, or in a business transaction such as a merger or asset transfer, subject to applicable safeguards.

A provider's role as processor, service provider, contractor, or independent controller depends on the service and applicable law. This policy does not replace that provider's own privacy notice.

6. Cookies, pixels, and similar technologies

Essential technologies support the cart, checkout, security, consent choices, and services you request. Optional technologies support analytics, advertising, and marketing. Cookies may last for a browser session or remain for the period set for that technology.

Our disclosed analytics and marketing tools are:

Google tags: support collection and transmission of website events for Google measurement services, including campaign attribution and conversion measurement. Advertising-related use can support audience matching or remarketing where enabled and lawfully permitted.

Google Analytics 4: measures visits, product interactions, navigation, and purchase events to help us understand store usage and performance. It can use cookie or device identifiers and technical information.

Meta Pixel: measures interactions and conversions associated with Meta advertising and can help build or match audiences for advertising on Meta services.

TikTok Pixel: measures website activity and conversions associated with TikTok advertising and can support advertising audience development.

Klaviyo: manages email subscriptions and marketing messages, audience segmentation, and campaign measurement. Where enabled and permitted, it uses website identifiers, message pixels, and tracked links to associate activity with a subscriber.

These tools are not classified as essential merely because they benefit our business. Optional technologies requiring consent must not be activated before that consent. Google consent settings do not replace the need to obtain valid consent where the law requires it.

7. Refusing or withdrawing tracking consent

You may refuse Google advertising tags, GA4 analytics, Meta Pixel, TikTok Pixel, and Klaviyo website tracking through the store's cookie-consent preferences by rejecting the relevant analytics or marketing categories. You may change those choices or withdraw consent through the same preference controls.

If the controls are unavailable or do not work, email help@avenoreyewear.com to request suppression of optional processing and report the issue. An email request is not a substitute for a consent mechanism where prior consent is legally required.

You can additionally block or delete cookies using your browser, adjust advertising choices in your Google, Meta, or TikTok account, and block remote images in your email application to reduce message-pixel tracking. These additional controls may not stop every form of processing or delete information already collected. Blocking essential cookies can affect checkout functionality.

Where applicable law requires us to recognize an opt-out preference signal, a valid Global Privacy Control signal must be treated as an opt-out of sale or sharing for the browser or device communicating it.

8. Email marketing

You may decline marketing or unsubscribe using the link in a marketing email or by emailing help@avenoreyewear.com. Marketing consent is requested where required by applicable law. Withdrawing marketing permission does not prevent transactional messages reasonably necessary for your order, refund, or a legally required notice.

9. International processing and transfers

Gfl Digital LLC is based in the United States. Shopify, marketing providers, fulfillment partners in China, and other service providers may process information outside your country. Those countries may have different privacy laws and lawful access rules.

Transfers subject to EU or UK restrictions require a valid legal mechanism, such as a relevant adequacy decision or appropriate contractual safeguards, with supplementary measures where necessary. This policy does not assert that Gfl Digital LLC is certified under a data privacy framework or that any particular transfer agreement has already been executed.

You may request information about the safeguards applicable to your information by emailing help@avenoreyewear.com. Merely using the store is not blanket consent to an international transfer requiring separate consent.

10. Retention and security

Information is retained for the purposes for which it was collected and any necessary legal retention period. Relevant criteria include completion of the order or refund, required accounting and tax records, unresolved disputes, applicable limitation periods, security needs, and your marketing or consent choices.

Information no longer needed is deleted, anonymized, or otherwise restricted as appropriate. Limited suppression records may be retained to ensure an unsubscribe or opt-out request remains effective.

We apply reasonable organizational and technical safeguards proportionate to the information and processing. No internet transmission or storage method can be guaranteed completely secure.

11. EU GDPR and UK GDPR rights

Where applicable, you may request access, correction, erasure, restriction, or portability, object to processing, withdraw consent, and challenge decisions based solely on automated processing where the relevant legal conditions are met.

You may object to direct marketing at any time. Contact help@avenoreyewear.com. We respond within the applicable statutory period, normally one month, with any permitted extension explained.

You may complain to your local supervisory authority. United Kingdom residents may contact the Information Commissioner's Office at https://ico.org.uk.

No EU- or UK-established representative is identified in this policy. Contacting the controller directly does not replace an appointment or disclosure required by applicable representation rules.

12. California: CCPA and CPRA

Where the California Consumer Privacy Act, as amended by the California Privacy Rights Act, applies, you may request access or disclosure, correction, or deletion, opt out of sale or sharing, limit qualifying uses of sensitive personal information, and exercise these rights without unlawful discrimination.

The information categories, sources, purposes, and recipients are described above. Disclosure of identifiers, online activity, commercial information, approximate location, or related inferences to advertising partners may constitute sale or sharing under California law, even when no money changes hands.

Submit requests to help@avenoreyewear.com. You may opt out of advertising disclosures through cookie preferences and applicable Global Privacy Control signals. An opt-out does not require an account.

An authorized agent may act for you, subject to lawful authorization and verification. We request proportionate information where identity verification is required, without applying that requirement to opt-out requests that do not require verification.

Access, correction, and deletion requests are handled within 45 calendar days, subject to a permitted extension with notice. Applicable opt-out and limitation requests are handled within their shorter statutory deadlines.

We do not knowingly sell or share information of individuals under 16 without the consent required by law. We do not use sensitive personal information to infer characteristics for advertising.

13. Canada

Where PIPEDA or applicable provincial privacy law applies, you may request access and correction, challenge compliance, and withdraw consent subject to lawful limitations and reasonable notice. Contact help@avenoreyewear.com. You may also complain to the competent Canadian privacy authority.

Information transferred for processing outside Canada remains subject to the applicable accountability requirements and may be accessible to authorities in the processing country under that country's laws.

14. Brazil

Where the LGPD applies, you may request confirmation of processing, access, correction, qualifying anonymization, blocking or deletion, portability under applicable rules, information about sharing and consent choices, withdrawal of consent, and review of qualifying automated decisions.

Requests may be sent to help@avenoreyewear.com. You may petition the Autoridade Nacional de Proteção de Dados or another competent authority. Processing relies on a lawful basis appropriate to its purpose, rather than unrestricted acceptance of this policy.

15. Other jurisdictions, requests, and complaints

Other applicable privacy laws may provide access, correction, deletion, consent withdrawal, advertising opt-outs, or appeal rights. Email help@avenoreyewear.com to make a request or appeal a decision. Where a right applies, the statutory deadline and exceptions govern.

We may retain information that cannot lawfully be erased, and we explain a refusal or limitation where required. Requests are normally free unless applicable law permits a charge.

16. Children

The store is intended for purchases by adults or persons acting with lawful parental or guardian involvement. We do not knowingly collect children's information for independent marketing or advertising profiling where prohibited. A parent or guardian may contact us about information provided by a child.

17. Changes and contact

Changes to this policy are posted with a revised effective date. Material changes requiring notice or renewed consent are handled accordingly. Continued use is not automatic consent to a new processing purpose requiring consent.
